✍️✍️ Bail Granted to Accused in Abortion and Rape Case

गर्भपात कराने और दुष्कर्म के मामले में आरोपी को मिली जमानत

वाराणसी:

जिला एवं सत्र न्यायालय (द्रुतगामी) प्रथम के न्यायाधीश कुलदीप सिंह की अदालत ने आजमगढ़ निवासी आरोपी मदन सिंह को गर्भपात कराने और बलात्कार के गंभीर मामले में जमानत दे दी।

👉 मामला मु.अ.सं. 125/2025 थाना चितईपुर, वाराणसी से संबंधित है। अभियुक्त पर वादी मुकदमा/पीड़िता ने आरोप लगाया था कि वर्ष 2016 में उसकी मुलाकात मदन सिंह से हुई। आरोपी ने उसे शादी का झांसा देकर शारीरिक संबंध बनाए। बाद में पीड़िता गर्भवती हो गई तो आरोपी ने कथित रूप से धोखे से दवा देकर गर्भपात करा दिया। इतना ही नहीं, पीड़िता और उसकी माता के साथ गाली-गलौज व जान से मारने की धमकी भी दी।

👉 वादी मुकदमा द्वारा दर्ज कराई गई प्राथमिकी पर आरोपी के विरुद्ध धारा 69, 89, 115(2), 351(2), 352, 333 बी.एन.एस. में केस दर्ज किया गया था।

बचाव पक्ष के तर्क

👉आरोपी की ओर से वरिष्ठ अधिवक्ता नितिन श्रीवास्तव, सिद्धार्थ श्रीवास्तव,प्रशांत श्रीवास्तव और देव वर्धन ने पक्ष रखते हुए कहा कि—

 यह अभियुक्त का प्रथम जमानत प्रार्थना पत्र है। किसी अन्य अदालत में इस संबंध में कोई जमानत प्रार्थना पत्र विचाराधीन या निस्तारित नहीं है। अवर न्यायालय ने अभियुक्त का प्रार्थना पत्र सरसरी तौर पर खारिज कर दिया था। वादी ने क्रोधवश और गलत सलाह से एफआईआर दर्ज कराई, अभियुक्त निर्दोष है।

अभियोजन पक्ष का विरोध

अभियोजन पक्ष ने जमानत का विरोध करते हुए कहा कि अपराध गंभीर प्रकृति का है, इसलिए अभियुक्त को रिहा नहीं किया जाना चाहिए।

न्यायालय का आदेश

न्यायालय ने सभी तथ्यों और दोनों पक्षों के तर्कों पर विचार करने के बाद अभियुक्त को 1 लाख रुपये के व्यक्तिगत बंधपत्र और समान धनराशि के दो जमानतदार प्रस्तुत करने की शर्त पर जमानत प्रदान की।

Bail Granted to Accused in Abortion and Rape Case

Varanasi:

The District and Sessions Court (Fast Track) I, presided over by Judge Kuldeep Singh, has granted bail to the accused, Madan Singh, a resident of Azamgarh, in a serious case involving abortion and rape.

Case Details

The case is registered as Crime No. 125/2025 at Chitaipur Police Station, Varanasi. The complainant/victim alleged that she met Madan Singh in 2016. The accused made sexual advances with the false promise of marriage. When the victim became pregnant, the accused allegedly tricked her into taking medication to induce an abortion. Furthermore, the accused is said to have verbally abused and threatened to kill the victim and her mother.

An FIR was filed by the complainant against the accused under Sections 69, 89, 115(2), 351(2), 352, and 333 of the BNS (Bharatiya Nyaya Sanhita).

Arguments from the Defense

Senior advocates Nitin Srivastava, Siddharth Srivastava, Prashant Srivastava, and Dev Vardhan, representing the accused, argued that:

 * This is the accused's first bail application. No other bail application is pending or has been decided in any other court.

 * The lower court had summarily rejected the accused's application.

 * The defense argued that the FIR was lodged by the complainant out of anger and on bad advice, and that the accused is innocent.

Prosecution's Opposition

The prosecution opposed the bail application, stating that the crime is of a serious nature and therefore the accused should not be released.

Court Order

After considering all the facts and the arguments from both sides, the court granted bail to the accused on the condition of furnishing a personal bond of ₹1 lakh and two sureties of the same amount.
