न्यायिक मजिस्ट्रेट प्रियल शर्मा की अदालत ने थाना भेलूपुर में दर्ज 34 वर्ष पुराने एक गंभीर प्रकरण में आरोपी बंगे उर्फ कैलाश पुत्र टैगरी सरदार, निवासी तिलभाण्डेश्वर को साक्ष्य के आभाव में संदेह का लाभ देते हुए दोषमुक्त कर दिया।

अभियोजन पक्ष का कथन
👉अभियोजन के अनुसार, दिनांक 06 नवम्बर 1991 को आरोपी ने वादिनी को अभद्र शब्दों का प्रयोग कर शर्मिंदा किया तथा जान से मारने की धमकी दी थी। इस संबंध में थाना भेलूपुर पर मुकदमा दर्ज हुआ।
साक्ष्य प्रस्तुत करने में विफलता
👉 पत्रावली के अवलोकन से स्पष्ट हुआ कि अभियुक्त के विरुद्ध 13 दिसम्बर 2010 को आरोप तय किए गए थे। इसके बाद से अभियोजन पक्ष को कई अवसर दिए गए, किंतु लगातार आदेशों के बावजूद कोई भी गवाह न्यायालय में पेश नहीं किया गया। प्रकरण लंबे समय से लंबित रहा और गवाहों का कोई पता न चल पाने के कारण 06 अगस्त 2025 को अभियोजन पक्ष का अवसर समाप्त कर दिया गया।
👉 12 अगस्त 2025 को आरोपी का बयान दंड प्रक्रिया संहिता की धारा 313 के तहत दर्ज किया गया, जिसमें उसने आरोपों से इनकार किया।
न्यायालय का निर्णय
👉 न्यायालय ने कहा कि अभियोजन पक्ष आरोपों को संदेह से परे साबित करने में असफल रहा है। इसलिए आरोपी बंगे उर्फ कैलाश को भारतीय दंड संहिता की धारा 294 और 506(2) के आरोपों से दोषमुक्त किया जाता है।

Man acquitted in 34-year-old case
Varanasi.
Judicial Magistrate Priyal Sharma's court acquitted the accused, Bange alias Kailash, son of Taigri Sardar, a resident of Tilbhandeshwar, in a 34-year-old serious case registered at Bhelupur police station. He was given the benefit of the doubt due to lack of evidence.
Criminal advocate Shyamsundar Chaurasia effectively represented the defense in court.
Prosecution's Statement
According to the prosecution, on November 6, 1991, the accused used vulgar words to embarrass the plaintiff and threatened to kill her. A case was registered in this regard at Bhelupur police station.
Failure to Present Evidence
It was clear from the case file that charges were framed against the accused on December 13, 2010. After this, the prosecution was given several opportunities, but despite continuous orders, no witness was presented in the court. The case remained pending for a long time, and since the whereabouts of the witnesses could not be traced, the prosecution's opportunity was closed on August 6, 2025.
On August 12, 2025, the accused's statement was recorded under Section 313 of the Code of Criminal Procedure, in which he denied the allegations.
Court's Decision
The court stated that the prosecution failed to prove the charges beyond a reasonable doubt. Therefore, the accused, Bange alias Kailash, is acquitted of the charges under Sections 294 and 506(2) of the Indian Penal Code.
