शादी का झांसा देकर नाबालिग से दुष्कर्म, आरोपी को 10 साल की सजा

विशेष न्यायाधीश (पाक्सो) अजय कुमार तृतीय की अदालत ने झांसा देकर शादी का प्रलोभन देने और लगातार दुष्कर्म करने के मामले में आरोपी विक्रम उर्फ विक्की साहू निवासी हुकूलगंज, पांडेयपुर थाना कैंट को दोषी करार देते हुए 10 वर्ष के सश्रम कारावास और 50 हजार रुपये अर्थदंड की सजा सुनाई। जुर्माना न देने पर एक वर्ष की अतिरिक्त कैद भुगतनी होगी।

इस मामले की पैरवी विशेष लोक अभियोजक मधुकर उपाध्याय और सहयोगी संतोष कुमार तिवारी ने साक्ष्यों व गवाहों के आधार पर प्रभावी ढंग से की।

अभियोजन के अनुसार पीड़िता गरीब परिवार की थी और आरोपी के घर बर्तन मांजने व साफ-सफाई का काम करती थी। विक्रम ने उसे शादी का झूठा वादा कर कई बार शारीरिक संबंध बनाए, जिससे वह गर्भवती हो गई। जब पीड़िता व उसकी मां ने आरोपी और उसकी पत्नी से शिकायत की तो उन्होंने गाली-गलौज कर भगा दिया।

इसके बाद पीड़िता ने 10 फरवरी 2015 को थाना कैंट में तहरीर दी। पुलिस ने विवेचना के बाद आरोपी के खिलाफ धारा 313, 376, 323, 504 आईपीसी व धारा 5(जे)(2)/6 पाक्सो के तहत मुकदमा दर्ज किया था।

Man sentenced to 10 years in prison for raping a minor after promising marriage

Varanasi:

The court of Special Judge (POCSO) Ajay Kumar III has convicted the accused, Vikram alias Vicky Sahu, a resident of Hukulganj, Pandeypur, Cantonment police station, and sentenced him to 10 years of rigorous imprisonment and a fine of Rs 50,000 for repeatedly raping a minor under the guise of promising marriage. If he fails to pay the fine, he will have to serve an additional one year in jail.

Special Public Prosecutor Madhukar Upadhyay and his associate Santosh Kumar Tiwari effectively handled the prosecution of this case based on evidence and witnesses.

According to the prosecution, the victim was from a poor family and worked at the accused's house, cleaning dishes and doing other chores. Vikram made a false promise of marriage and had physical relations with her multiple times, leading her to become pregnant. When the victim and her mother complained to the accused and his wife, they were verbally abused and chased away.

Following this, the victim filed a complaint at the Cantonment police station on February 10, 2015. After an investigation, the police registered a case against the accused under sections 313, 376, 323, 504 of the IPC and section 5(j)(2)/6 of the POCSO Act.
