पॉक्सो एक्ट के मामले में आरोपी को कोर्ट से मिली राहत

विशेष न्यायालय पॉक्सो एक्ट के न्यायाधीश नितिन पांडेय की अदालत ने थाना चौबेपुर में दर्ज एक गंभीर आपराधिक मामले में अभियुक्त सुनील कुमार उर्फ सोनू पुत्र बिरजू निवासी संदहा कला, थाना चौबेपुर की ओर से प्रस्तुत जमानत प्रार्थना पत्र को स्वीकार कर लिया।

👉 अभियोजन पक्ष के अनुसार, घटना 31 अक्टूबर 2019 की सुबह लगभग 5 बजे की है। वादी मुकदमा की पुत्री, जिसकी उम्र 18 वर्ष बताई गई है, घर पर अकेली थी। उसी दौरान पड़ोसी अभियुक्तगण घर की चहारदीवारी फांदकर अंदर घुस आए और उससे बदनीयती से छेड़छाड़ करने लगे। विरोध करने पर अभियुक्तों ने वादी की पुत्री के साथ मारपीट कर अंदरूनी चोटें पहुँचाईं।

👉 शोर सुनकर उसकी माँ और बहन जब बचाने आईं तो अभियुक्तों ने उनके साथ भी बाल नोचकर मारपीट और अभद्र गालियाँ दीं। वादी मुकदमा उस समय राजवारी स्थित श्यामा हरिवंश महाविद्यालय में रात्रि ड्यूटी पर था, जबकि पुत्र सुबह दौड़ने गया हुआ था। घर में पुरुषों की अनुपस्थिति का लाभ उठाकर अभियुक्तों ने घटना को अंजाम दिया।

👉 घटना की सूचना 100 नंबर पर दी गई, पुलिस मौके पर पहुंची लेकिन अभियुक्तों के खिलाफ तत्काल कोई कार्रवाई नहीं हुई। बाद में कई बार थाना और वरिष्ठ पुलिस अधीक्षक को प्रार्थना पत्र भेजे गए, किंतु कोई कार्रवाई न होने पर अदालत के आदेश पर मामला धारा 452, 354क, 354ख, 323, 504, 506 भादंवि एवं 7/8 पॉक्सो एक्ट में दर्ज किया गया।

Accused Gets Relief from Court in POCSO Act Case

Varanasi.

The court of Special Judge POCSO Act, Nitin Pandey, accepted the bail application presented by the accused Sunil Kumar alias Sonu, son of Birju, resident of Sandaha Kala, Police Station Chaubepur, in a serious criminal case registered at Police Station Chaubepur.

👉 According to the prosecution, the incident occurred around 5 AM on October 31, 2019. The complainant's daughter, whose age is stated to be 18 years, was alone at home. During that time, the neighboring accused scaled the boundary wall of the house, entered inside, and started molesting her with ill intent. Upon resistance, the accused assaulted the complainant's daughter, causing internal injuries.

👉 When her mother and sister came to her rescue after hearing the noise, the accused also assaulted them by pulling their hair and subjected them to abusive language. The complainant was on night duty at Shyama Harivansh Mahavidyalaya in Rajwari at the time, while his son had gone out for a run in the morning. The accused took advantage of the absence of men in the house to commit the crime.

👉 The incident was reported on dial 100, and the police arrived at the spot, but no immediate action was taken against the accused. Later, several applications were sent to the police station and the Senior Superintendent of Police, but as no action was taken, the case was registered on the court's order under Sections 452 (House-trespass), 354A (Sexual harassment), 354B (Assault or use of criminal force to woman with intent to disrobe), 323 (Voluntarily causing hurt), 504 (Intentional insult with intent to provoke breach of the peace), 506 (Criminal intimidation) of the Indian Penal Code (IPC) and Sections 7/8 of the POCSO Act.
