✍️✍️ Anticipatory Bail Granted to Accused of Fraud in the Name of Marriage

शादी के नाम पर धोखाधड़ी के आरोपी को मिली अग्रिम जमानत

विशेष न्यायालय भ्रष्टाचार निवारण अधिनियम के न्यायाधीश अवधेश कुमार द्वितीय की अदालत ने थाना फूलपुर में दर्ज एक गंभीर आपराधिक मामले में अभियुक्त महेंद्र की ओर से प्रस्तुत अग्रिम जमानत प्रार्थना पत्र को स्वीकार कर लिया है।

👉 अभियोजन पक्ष के अनुसार, पीड़ित पेमा राम पुत्र गैला राम निवासी राणानास, थाना सिरपारी, जिला पाली (राजस्थान) ने थाना फूलपुर में तहरीर देकर आरोप लगाया कि उसने अपने बड़े भाई रामलाल की शादी के लिए सोनभद्र निवासी महेंद्र से संपर्क किया था।

👉 महेंद्र ने विवाह के नाम पर ₹90,000 रुपये सुनील कुमार को गूगल पे के माध्यम से और ₹1,30,000 रुपये नकद लिए। इसके बाद उसने विवाह हेतु अनिता पत्नी सरजु निवासी रईया थाना रायपुर, सोनभद्र को बुलाया और पीड़ित को बाबतपुर एयरपोर्ट पर बुलाया।

👉 जब महेंद्र और उसके सहयोगी योगेंद्र पुत्र राजेंद्र (ग्राम जैसोलिया, थाना रायपुर, सोनभद्र) वहां से चले गए, तभी अनिता ने एयरपोर्ट सुरक्षा कर्मियों को बताया कि उसे जबरन ले जाया जा रहा है और यह पूरा मामला धोखाधड़ी से जुड़ा है।

👉 इस प्रकरण में पुलिस ने भारतीय न्याय संहिता (BNS) की धारा 318(2) और 316(2) के तहत मुकदमा पंजीकृत किया था।

👉 According to the prosecution, the victim, Pema Ram son of Gaila Ram, a resident of Rananwas, Sirpari Police Station, Pali District (Rajasthan), filed a complaint at Phulpur Police Station, alleging that he had contacted Mahendra, a resident of Sonbhadra, for the marriage of his elder brother, Ramlal.

👉 Mahendra allegedly took ₹90,000 via Google Pay to Sunil Kumar and ₹1,30,000 in cash in the name of marriage. After this, he called an Anita wife of Sarju, a resident of Raiya, Raipur Police Station, Sonbhadra, for the marriage and called the victim to Babatpur Airport.

👉 When Mahendra and his associate Yogendra son of Rajendra (resident of Jaisoliya village, Raipur Police Station, Sonbhadra) left the spot, Anita informed the airport security personnel that she was being taken forcibly and that the entire matter was related to fraud.

👉 In this case, the police registered a case under sections 318(2) and 316(2) of the Bharatiya Nyaya Sanhita (BNS).

Note: BNS 318 pertains to cheating, and BNS 316 pertains to punishment for simple cheating.
