पॉक्सो कोर्ट से तीन आरोपियों को मिली राहत, अग्रिम जमानत मंजूर

 विशेष न्यायालय पॉक्सो एक्ट के न्यायाधीश नितिन पांडेय की अदालत ने थाना लोहता में दर्ज एक गंभीर आपराधिक मामले में अभियुक्तगण मुमताज, मुन्ना उर्फ मुर्तजा अली तथा बबलू उर्फ मोहम्मद एजाज की ओर से प्रस्तुत अग्रिम जमानत प्रार्थना पत्र को स्वीकार कर लिया।

👉 अभियोजन के अनुसार, वादिनी एक गरीब महिला है जो मजदूरी कर अपने परिवार का भरण-पोषण करती है। उसने अपनी पुत्री की शादी के लिए 50 हजार रूपए जमा किए थे, जिसे विपक्षीगण में से एक मुमताज ने व्यापार हेतु उधार लिया। जब वादिनी ने पैसा वापस मांगा, तो उसे गाली-गलौज कर घर से निकाल दिया गया।

👉 दिनांक 31 दिसंबर 2019 को वादिनी अपनी नाबालिग पुत्री के साथ घर पर अकेली थी, तभी सभी अभियुक्तगण घर में जबरन घुस आए और मारपीट की। आरोप है कि अभियुक्त शहजाद आलम ने वादिनी की पुत्री के साथ अश्लील हरकतें कीं और बलात्कार का प्रयास किया। शोर मचाने पर आस-पड़ोस के लोग इकट्ठा हुए, जिसके बाद सभी अभियुक्त जान से मारने की धमकी देकर फरार हो गए।

👉 बता दें कि इस संबंध में थाना लोहता में मु०अ०सं०-247/2020 के तहत धारा 147, 149, 452, 323, 504, 506, 354(क), 354(ख), 376, 511, 406 भा.दं.सं. एवं 7/8 पॉक्सो एक्ट के अंतर्गत अभियोग दर्ज किया गया।

POCSO Court Grants Relief to Three Accused, Anticipatory Bail Approved

The court of Special Judge POCSO Act, Nitin Pandey, accepted the application for anticipatory bail presented by the accused Mumtaz, Munna alias Murtaza Ali, and Bablu alias Mohammad Ejaz in a serious criminal case registered at Lohta Police Station.

"Criminal advocate Swatantra Kumar Jaiswal argued the case on behalf of the defence."

👉 According to the prosecution, the complainant is a poor woman who supports her family by working as a labourer. She had saved ₹50,000 for her daughter's wedding, which one of the opposite parties, Mumtaz, borrowed for business. When the complainant asked for the money back, she was verbally abused and thrown out of the house.

👉 On December 31, 2019, the complainant was alone at home with her minor daughter, when all the accused forcibly entered the house and assaulted them. It is alleged that the accused Shahzad Alam made obscene gestures towards the complainant's daughter and attempted to rape her. When the complainant raised an alarm, neighbours gathered, after which all the accused fled after threatening to kill them.

👉 It is to be noted that in this regard, a case was registered at Lohta Police Station under Case No. 247/2020 under Sections 147, 149, 452, 323, 504, 506, 354(A), 354(B), 376, 511, 406 of the Indian Penal Code (IPC) and Sections 7/8 of the POCSO Act.
