एससी/एसटी एक्ट और लूट के गंभीर आरोप,कोर्ट ने दी राहत

विशेष न्यायालय एससी/एसटी एक्ट की न्यायाधीश संध्या श्रीवास्तव की अदालत ने थाना कैंट क्षेत्र के एक गंभीर आपराधिक मामले में ग्राम सरैया, फुलवरिया निवासी अभियुक्त रंजन पटेल की ओर से प्रस्तुत जमानत प्रार्थना पत्र स्वीकार कर लिया।

👉मामले में परिवादी प्रकाश आनन्द राव, जो अनुसूचित जाति के हैं, ने आरोप लगाया था कि अभियुक्त व अन्य सह-अभियुक्तगण ने 14 नवम्बर 2023 को उनके घर में घुसकर जातिसूचक शब्दों से अपमानित किया, मारपीट की, सामान तोड़ा, और 1750 रुपये लूट लिए।

👉वहीं, बचाव पक्ष ने दलील दी कि मुकदमा पूर्व रंजिश और प्रतिशोध के तहत दायर किया गया है। अभियुक्त की पत्नी द्वारा परिवादी के विरुद्ध पहले से बलात्कार के प्रयास का मुकदमा दर्ज कराया गया था, जिसकी वजह से यह परिवाद बदले की कार्रवाई के रूप में दाखिल हुआ।

👉अदालत ने दोनों पक्षों के तर्कों को सुनने के बाद अभियुक्त रंजन पटेल को जमानत प्रदान की।

👉मामला परिवाद संख्या-19/2024, थाना कैंट, वाराणसी से संबंधित है, जिसमें विभिन्न धाराएं — 323, 504, 506, 452, 427, 392 IPC एवं धारा 3(1)(ध) एससी/एसटी एक्ट — लागू की गई थीं।

The court of Special Judge SC/ST Act, Sandhya Srivastava, accepted the bail application presented on behalf of the accused, Ranjan Patel, resident of Saraiya, Phulwariya village, in a serious criminal case from the Cantt Police Station area.

"Criminal advocate Kaushal Kumar presented the case on behalf of the defense."

👉 In the matter, the complainant, Prakash Anand Rao, who belongs to the Scheduled Caste, had alleged that the accused and other co-accused entered his house on November 14, 2023, insulted him with caste-related slurs, assaulted him, broke household items, and looted ₹1750.

👉 However, the defense argued that the case was filed due to prior animosity and vendetta. The accused's wife had previously filed a case against the complainant for attempted rape, which is why this complaint was filed as an act of revenge.

👉 After hearing the arguments from both sides, the court granted bail to the accused, Ranjan Patel.

👉 The case relates to Complaint Number-19/2024, Cantt Police Station, Varanasi, in which various sections — 323, 504, 506, 452, 427, 392 IPC and Section 3(1)(dh) of the SC/ST Act — were applied.
