सत्र न्यायालय के न्यायाधीश जयप्रकाश तिवारी की अदालत ने थाना चौबेपुर क्षेत्र के एक गंभीर मामले में ग्राम तातेपुर कमौली निवासी तेजू निषाद की ओर से प्रस्तुत जमानत प्रार्थना पत्र व दिनेश निषाद की ओर से दायर अग्रिम जमानत प्रार्थना पत्र को निरस्त कर दिया।

अभियोजन पक्ष के अनुसार घटना का विवरण
👉 वादिनी/पीड़िता ने अपनी तहरीर में आरोप लगाया कि 25 मई 2025 की शाम लगभग 7 बजे वह अपने घर से पाही (मड़ई) पर पशुओं को अलगाने जा रही थी। इसी दौरान गाँव के ही तीन युवक— तेजू निषाद पुत्र गनपत निषाद (25 वर्ष), दिनेश निषाद पुत्र भग्गू निषाद (23 वर्ष),रामविलास उर्फ करिया पुत्र नौरंग निषाद (22 वर्ष) पहले से मड़ई में छिपे बैठे थे। जैसे ही पीड़िता नडई में पहुंची, तेजू ने पीछे से उसका मुंह दबा लिया और हाथ में चाकू लेकर धमकी दी कि चुप रहे, नहीं तो गला रेत देगा। इसके बाद दिनेश व रामविलास ने उसे जबरन मड़ई में खींच लिया, जहां तेजू ने उसे जमीन पर गिराकर कपड़े उतार दिए और जबरन दुष्कर्म किया।
👉 पीड़िता के प्रतिरोध में दांत से काटने पर दिनेश व रामविलास ने उसकी पिटाई की और दुष्कर्म का प्रयास किया, किंतु शोर मचाने पर तीनों वहां से भाग गए। जाते-जाते उन्होंने धमकी दी कि घटना की जानकारी किसी को दी तो उसे व उसके माता-पिता को जान से मार देंगे।
👉 पीड़िता का आरोप है कि इससे पहले भी तीनों आरोपी उसके साथ छेड़खानी व अश्लील टिप्पणियां करते थे। पीड़िता के पिता द्वारा टोके जाने पर आरोपियों ने उन्हें भी जान से मारने की धमकी दी थी।
मामला दर्ज
👉 पीड़िता की तहरीर पर थाना चौबेपुर पुलिस ने बीएनएस की धारा 70(1), 115(2), व 351(2) के तहत मुकदमा पंजीकृत किया था।
👉 गंभीर आरोपों और मामले के संवेदनशील स्वरूप को देखते हुए अदालत ने दोनों अभियुक्तों की याचिका खारिज कर दी।

Bail Applications of Two Accused in Gang-Rape Case Rejected

The court of Session Judge Jaiprakash Tiwari has rejected the bail application filed by Teju Nishad and the anticipatory bail application filed by Dinesh Nishad, both residents of Tatepur Kamauli village, in a serious case from the Chaubepur police station area.

Details of the Incident as per the Prosecution
👉 In her complaint, the victim alleged that on the evening of May 25, 2025, around 7 p.m., she was going from her house to the "pahi" (hut) to separate the animals. During this time, three men from the same village—Teju Nishad, son of Ganpat Nishad (25 years), Dinesh Nishad, son of Bhaggu Nishad (23 years), and Ramvilas alias Kariya, son of Naurang Nishad (22 years)—were already hiding inside the hut. As soon as the victim reached the hut, Teju covered her mouth from behind and threatened her with a knife, telling her to be quiet or he would slit her throat. After this, Dinesh and Ramvilas forcibly dragged her into the hut, where Teju pushed her to the ground, removed her clothes, and forcibly raped her.
👉 When the victim resisted and bit them, Dinesh and Ramvilas beat her and attempted to rape her. However, the three fled after she started screaming. As they left, they threatened that if she told anyone about the incident, they would kill her and her parents.
👉 The victim also alleged that the three accused had previously molested her and made obscene comments. When the victim's father confronted the accused, they also threatened to kill him.
Case Registered
👉 Based on the victim's complaint, the Chaubepur Police registered a case under sections 70(1), 115(2), and 351(2) of the Bharatiya Nyaya Sanhita (BNS).
👉 Due to the serious allegations and the sensitive nature of the case, the court rejected the applications of both accused.
