स्पेशल जज भ्रष्टाचार निवारण अधिनियम (यूपीएसईबी) वाराणसी के न्यायाधीश विनोद प्रसाद की अदालत ने गुरुवार को एक चर्चित हत्या कांड में फैसला सुनाते हुए चार अभियुक्तों — पूनम मिश्रा, भूपेंद्र नाथ तिवारी, प्रमोद कुमार तिवारी उर्फ प्रमोद कुमार त्रिपाठी और नरेंद्र त्रिपाठी उर्फ शिब्लू — को आजीवन कारावास की सजा तथा प्रत्येक को एक लाख रुपए के अर्थदंड से दंडित किया है।
👉 यह मामला बनारस बार एसोसिएशन, वाराणसी के पूर्व अध्यक्ष इंद्र देव मिश्रा के पुत्र स्व नीरज मिश्रा की विषप्रयोग से हत्या से संबंधित है।

प्रकरण का विवरण
👉 अभियोजन के अनुसार, दिनांक 17 अक्टूबर 2015 को नीरज मिश्रा अपने मित्र भूपेंद्र तिवारी के साथ बरही स्थित एक कार्यक्रम में महाराजा गार्डन, आशापुर गए थे। रास्ते में उन्हें शराब के गिलास में नुआन प्वाइजन मिलाकर पिलाया गया। घर लौटने के बाद उनकी तबीयत बिगड़ गई और उन्हें बीएचयू अस्पताल ले जाया गया, जहाँ चिकित्सकों ने उन्हें मृत घोषित कर दिया।
👉 पोस्टमार्टम के दौरान विषप्रयोग की पुष्टि हुई। मृतक के जीजा वेद प्रकाश पांडेय द्वारा दी गई तहरीर पर मुकदमा दर्ज हुआ। विवेचना में स्पष्ट हुआ कि अभियुक्त पूनम मिश्रा और मृतक नीरज मिश्रा के बीच भूमि लेनदेन का विवाद चल रहा था।
👉 नीरज मिश्रा ने पूनम मिश्रा को जमीन के बदले 29 लाख रुपए का भुगतान किया था, परंतु वादिनी ने जमीन न देने के साथ-साथ दी गई चेक राशि भी अनादृत हो गई। इसी विवाद और 29 लाख रुपए की रकम न लौटाने के कारण पूनम मिश्रा ने अन्य अभियुक्तों के साथ षड्यंत्र कर नीरज मिश्रा की हत्या करवाई।
न्यायालय का निर्णय
👉 मुकदमे की सुनवाई के दौरान अभियोजन पक्ष द्वारा 13 गवाहों को प्रस्तुत किया गया, जिनके साक्ष्यों से अभियुक्तों की संलिप्तता सिद्ध हुई। दोनों पक्षों की बहस सुनने के बाद न्यायालय ने सभी चारों अभियुक्तों को दोषी पाते हुए आजीवन कारावास और एक लाख रुपए के अर्थदंड की सजा सुनाई।
👉 बता दें कि मृतक नीरज मिश्रा के पिता इंद्र देव मिश्रा बनारस बार एसोसिएशन के पूर्व अध्यक्ष रहे हैं, जबकि उनके भाई संजय मिश्रा और जीजा वेद प्रकाश पांडेय भी वाराणसी कचहरी में अधिवक्ता हैं।

The court of Special Judge Prevention of Corruption Act (UPSEB), Varanasi, Vinod Prasad, on Thursday pronounced its verdict in a prominent murder case, sentencing the four accused—Poonam Mishra, Bhupendra Nath Tiwari, Pramod Kumar Tiwari alias Pramod Kumar Tripathi, and Narendra Tripathi alias Shiblu—to life imprisonment and imposing a fine of one lakh rupees on each.
👉 This case relates to the murder of the late Neeraj Mishra, son of Indra Dev Mishra, former President of the Banaras Bar Association, Varanasi, by poisoning.
"Prosecution was effectively advocated by Rohit Maurya (Assistant District Government Counsel, Criminal), while advocates Rajendra Kumar Singh and Sudhanshu Gupta were present on behalf of the plaintiff."
Case Details
👉 According to the prosecution, on October 17, 2015, Neeraj Mishra went to an event at Maharaja Garden, Ashapur, in Barhi, along with his friend Bhupendra Tiwari. On the way, he was allegedly given a mixture of Nuvan poison in a glass of liquor. After returning home, his health deteriorated, and he was taken to BHU Hospital, where doctors declared him dead.
👉 Poisoning was confirmed during the post-mortem. A case was registered based on the complaint filed by the deceased's brother-in-law, Ved Prakash Pandey. The investigation revealed that a land transaction dispute was ongoing between the accused Poonam Mishra and the deceased Neeraj Mishra.
👉 Neeraj Mishra had paid ₹29 lakh to Poonam Mishra for the land, but the petitioner (Poonam Mishra) neither gave the land nor was the check amount returned (it was dishonored). Due to this dispute and the failure to return the ₹29 lakh, Poonam Mishra conspired with the other accused and had Neeraj Mishra murdered.
Court's Decision
👉 During the trial, the prosecution presented 13 witnesses, whose testimonies proved the involvement of the accused. After hearing the arguments from both sides, the court found all four accused guilty and sentenced them to life imprisonment and a fine of one lakh rupees.
👉 It is notable that the deceased Neeraj Mishra’s father, Indra Dev Mishra, was the former President of the Banaras Bar Association, while his brother Sanjay Mishra and brother-in-law Ved Prakash Pandey are also advocates at the Varanasi Civil Court (Kachehri).
