विशेष न्यायालय (भ्रष्टाचार निवारण अधिनियम-यूपीएसईबी) के न्यायाधीश विनोद कुमार की अदालत ने थाना सिगरा में दर्ज गंभीर आपराधिक मामले में ग्राम कंचनपुर भिखारीपुर, थाना मंडुवाडीह निवासी अभियुक्त उपेंद्र श्रीवास्तव उर्फ बाबू की ओर से दाखिल जमानत प्रार्थना पत्र को खारिज कर दिया।
अदालत में अभियोजन पक्ष की ओर से सहायक जिला शासकीय फौजदारी अधिवक्ता रोहित मौर्य व सहयोगी अधिवक्ता सुधांशु गुप्ता ने जोरदार आपत्ति जताई
अभियोजन पक्ष का आरोप
👉अभियोजन के अनुसार, 15 वर्षीय मृतका 1 सितंबर 2023 को घर से निकली थी। काफी देर तक वापस न लौटने पर परिजनों ने तलाश शुरू की। कुछ दिन बाद मृतका का अधजला शव थाना गोपीगंज, भदोही से बरामद हुआ। पोस्टमार्टम रिपोर्ट में मृतका के शरीर पर आठ गंभीर चोटें व जननांगों पर क्षति पाई गई।
👉जांच के दौरान सीसीटीवी फुटेज व अन्य साक्ष्यों के आधार पर अभियुक्त उपेंद्र श्रीवास्तव का नाम प्रकाश में आया। अभियोजन का आरोप है कि अभियुक्त ने मृतका की हत्या कर शव पर पेट्रोल छिड़ककर जलाया और साक्ष्य मिटाने का प्रयास किया।
बचाव पक्ष की दलील
👉बचाव पक्ष का तर्क था कि अभियुक्त को झूठा फंसाया गया है। मृतका लंबे समय से अभियुक्त के संपर्क में थी और दोनों परिवारों का आना-जाना भी था। अभियुक्त का कहना है कि वह निर्दोष है और घटना से कोई संबंध नहीं रखता।
न्यायालय का निर्णय
👉न्यायालय ने कहा कि पत्रावली के अवलोकन से स्पष्ट है कि मृतका की मृत्यु अभियुक्त के घर पर हुई और बाद में उसका अधजला शव अन्य स्थान से बरामद हुआ। यह परिस्थितियां अभियुक्त की संलिप्तता दर्शाती हैं। ऐसे में गंभीर अपराध को देखते हुए जमानत देने का कोई आधार नहीं बनता।
👉 अदालत ने अभियुक्त उपेंद्र श्रीवास्तव उर्फ बाबू पुत्र स्व. राम मोहन श्रीवास्तव का प्रथम जमानत प्रार्थना पत्र संख्या 3052/2025, मु.अ.सं. 248/2023, अंतर्गत धारा 363, 366, 302, 201 भा.दं.स., थाना सिगरा, जनपद वाराणसी निरस्त कर दिया।

15-Year-Old Girl Abducted and Murdered, Charred Body Found in Bhadohi, Court Denies Bail
Varanasi:
In a serious criminal case registered at Sigra police station, the court of Justice Vinod Kumar of the Special Court (Prevention of Corruption Act-UPSEB) rejected the bail application filed by the accused, Upendra Srivastava alias Babu, a resident of village Kanchanpur Bhikaripur, police station Manduadih.
Assistant District Government Advocate (Criminal) Rohit Kumar Maurya and associate advocate Sudhanshu Gupta strongly objected on behalf of the prosecution in court.
Prosecution's Allegation
* According to the prosecution, the 15-year-old victim left her home on September 1, 2023. When she didn't return after a long time, her family started searching for her. A few days later, the victim's partially burnt body was found in Gopiganj, Bhadohi. The post-mortem report revealed eight serious injuries and damage to her genitals.
* During the investigation, the name of the accused, Upendra Srivastava, came to light based on CCTV footage and other evidence. The prosecution alleges that the accused murdered the victim, poured petrol on her body to burn it, and attempted to destroy the evidence.
Defense's Argument
* The defense argued that the accused was falsely implicated. The victim had been in contact with the accused for a long time, and both families were known to each other. The accused claimed he was innocent and had no connection to the incident.
Court's Decision
* The court stated that a review of the case file makes it clear that the victim died at the accused's house and her charred body was later found at another location. These circumstances indicate the accused's involvement. Therefore, given the seriousness of the crime, there is no basis for granting bail.
* The court dismissed the first bail application (No. 3052/2025) of the accused, Upendra Srivastava alias Babu, son of the late Ram Mohan Srivastava, in connection with Case No. 248/2023, under Sections 363, 366, 302, 201 of the Indian Penal Code, at Sigra Police Station, District varanasi.
