न्यायिक मजिस्ट्रेट प्रियल शर्मा की अदालत ने भेलूपुर थाने में दर्ज एक गंभीर आपराधिक मामले में आरोपी पवन सिंह उर्फ विक्की सिंह की जमानत अर्जी को स्वीकार कर लिया है। अदालत ने आदेश दिया कि अभियुक्त को 25,000 रुपये के निजी मुचलके और समान राशि के दो प्रतिभू प्रस्तुत करने पर जेल से रिहा किया जाए।
मामला क्या है?
👉 वादी श्यामजी गुप्ता, निवासी खोजवा ने थाना भेलूपुर में तहरीर देकर बताया था कि उनकी ई-रिक्शा (संख्या UP 65 MT 0374) दिनांक 3 अगस्त 2025 की रात कोलहुआ विनायक में खड़ी थी, जिसे अज्ञात चोर चोरी कर ले गए। तहरीर के आधार पर थाना भेलूपुर पुलिस द्वारा अज्ञात में बीएनएस की धारा 303(2) व 317(2) में मुकदमा पंजीकृत किया गया था, दौरान विवेचना अभियुक्त पवन सिंह उर्फ विक्की सिंह का नाम प्रकाश में आया था।

👉 पत्रावली का अवलोकन करने पर न्यायालय ने पाया कि आरोपित अपराध अधिकतम तीन वर्ष के कारावास से दंडनीय है और यह मजिस्ट्रेट न्यायालय द्वारा विचारणीय है। अभियुक्त वर्तमान में जिला कारागार में निरुद्ध है। इन तथ्यों एवं परिस्थितियों को देखते हुए न्यायालय ने जमानत को उचित माना।

न्यायालय ने कहा कि अभियुक्त पवन सिंह उर्फ विक्की सिंह की ओर से प्रस्तुत जमानत प्रार्थना पत्र स्वीकार किया जाता है।

What is the case?
The complainant, Shyamji Gupta, a resident of Khojwa, had filed a report at the Bhelupur police station stating that his e-rickshaw (number UP 65 MT 0374), which was parked at Kolhua Vinayak on the night of August 3, 2025, had been stolen by an unknown thief. Based on the complaint, the Bhelupur police registered a case against an unknown person under sections 303(2) and 317(2) of the BNS. During the investigation, the name of the accused, Pawan Singh alias Vicky Singh, came to light.
Arguments of the Prosecution and Defense
Advocates Rup Kunwar Seth and Gaurang Vajpayee effectively argued on behalf of the defense in court. The prosecution officer, on the other hand, opposed the bail, stating that the crime was non-bailable.
Upon reviewing the case file, the court found that the alleged offense is punishable with a maximum of three years of imprisonment and is triable by a magistrate court.
