मक़दमे की रंजिश को लेकर महिला के घर में घुसकर छेड़खानी, लूट व प्राणघातक हमला करने के मामले में अपर मुख्य न्यायिक मजिस्ट्रेट (सप्तम) वर्तिका शुभानंद की अदालत ने 13 नामजद और 6 अज्ञात के खिलाफ मुकदमा दर्ज करने का आदेश बड़ागांव पुलिस को दिया है।

👉 प्रकरण के अनुसार बडगांव बाजार निवासिनी पीड़िता ने अपने अधिवक्ता के जरिए अदालत में बीएनएसएस की धारा 173(4) के तहत प्रार्थना पत्र दिया था। आरोप था कि पूर्व से ही उसके परिवार की रंजिश गांव के ही कामरान से है। इसी रंजिश के चलते 01 फरवरी 2024 को उसके पुत्र साहुन अहमद को कामरान, कामिल व जमीन ने बुरी तरह मारा पीटा था। जिसके सम्बंध में प्रार्थिनी के पति मुनौव्वर अली द्वारा थाना बडागांव में उपरोक्त लोगो के खिलाफ मुकदमा दर्ज कराया गया था। इसी बात की रंजिश को लेकर कामरान ने 03 अप्रैल 2025 को 8 बजे रात्रि जब प्रार्थिनी के पति अपने पुराने घर जा रहे थे तो नदी के पास अपने एक मित्र के साथ रोक कर भद्दी-भद्दी गालियां व जान से मारने की धमकी दिया था। जिसकी शिकायत बड़ागांव थाने में की गई थी। इस कार्यवाही से क्षुब्ध व आक्रोशित होकर 12 मई 2025 को जब प्रार्थिनी का छोटा पुत्र दानिश घर के बगल में स्थित तकिया मैदान में क्रिकेट खेल रहा था, उसी समय बाबू नाऊ ने दानिश को क्रिकेट खेलने से रोकने लगा, जब दानिश ने विरोध किया तो बाबू नाऊ गलियां देने लगा। उसी समय मैदान पर मौजूद कामरान व उसके दोस्त सैफ, साहिल भी बाबू नाऊ का पक्ष लेकर दानिश को मारने-पीटने लगे। इसकी जानकारी मिलने पर जब उसका बड़ा पुत्र साहुन, दानिश को बचाने तकिया मैदान पहुँचा तो वे लोग दोनों को मारने के लिए दौड़ाए। जिस पर प्रार्थिनी के दोनो पुत्र अपनी जान बचाने के लिए भागते हुये घर आये तथा डरवश दुकान का शटर गिराने लगे, तभी सभी अभियुक्तगण अपने-अपने हाथो में लाठी-डण्डा, राड व चाकू लेकर आ गये तथा राड से शटर को चाड़कर अंदर घुस आये तथा उसके पुत्र साहुन को मारने लगे तथा दुकान में रखे करीब डेढ़ लाख के सामानों को तोड़ फोड़ कर पूरी तरह क्षतिग्रस्त कर दिये। जब प्रार्थिनी अपने पुत्रो को बचाने आयी तो अभियुक्तों ने उसे भी मारने-पीटने लगे तथा यासीन ने उसके साथ अश्लील हरकत कर उसे अर्धनग्न कर दिया तथा सैफ ने बलपूर्वक प्रार्थिनी के सर के बालो को पकड़कर खींचा। जिससे प्रार्थिनी के सर के काफी बाल जड़ से उखड़ गये। इसी दौरान कामरान ने प्रार्थिनी के कान की सोने की बाली नोंच लिया तथा साहिल व सलमान तथा यासीन ने जबदरस्ती दुकान के गल्ले में रखा बिक्री का लगभग 45,000/-रूपया लूट लिया। इस मामले में पुलिस को सूचना देने के बाद भी जब कोई कार्यवाही नहीं हुई तो पीड़िता ने अदालत की शरण ली।

Case Registered Against 13 Named and 6 Unknown Individuals: A Case of Trespassing, Molestation, Robbery, and Attempted Murder

The court of Additional Chief Judicial Magistrate (VII), Vartika Shubhanand, has ordered the Badagaon police to register a case against 13 named and 6 unknown individuals in a matter involving a dispute over an ongoing case that escalated into a home invasion with molestation, robbery, and a fatal assault.

Details of the Allegations
👉 According to the case, the victim, a resident of Badagaon market, submitted an application to the court through her lawyer under Section 173(4) of the BNSS. She alleged that her family already had a long-standing feud with a person named Kamran from the same village. Due to this animosity, on February 1, 2024, her son, Sahun Ahmed, was severely beaten by Kamran, Kamil, and Zamin. Her husband, Munawwar Ali, had filed a police report against the individuals at the Badagaon police station regarding this incident.
Further escalating the dispute, on April 3, 2025, at 8:00 PM, as the victim's husband was going to his old house, Kamran, along with a friend, stopped him near the river, abused him, and threatened to kill him. A complaint about this incident was also filed at the Badagaon police station.
Angered by these actions, on May 12, 2025, when the victim's younger son, Danish, was playing cricket on the nearby Takia Maidan ground, an individual named Babu Naun tried to stop him. When Danish protested, Babu Naun began to abuse him. At the same time, Kamran and his friends Saif and Sahil, who were also at the ground, took Babu Naun's side and began to beat Danish. When the victim's older son, Sahun, arrived to rescue Danish, the attackers chased both of them.
The two brothers ran home to save their lives and were pulling down the shop shutter in fear when the accused, armed with sticks, rods, and a knife, pried open the shutter and forced their way inside. They began beating Sahun and completely vandalized goods worth about ₹1.5 lakh in the shop. When the victim tried to save her sons, the accused also started to beat her. Yasin allegedly sexually assaulted her, leaving her half-naked, while Saif forcefully pulled her hair, causing a significant amount of it to be uprooted from the roots. During this assault, Kamran snatched the gold earrings from her ears, and Sahil, Salman, and Yasin forcefully looted approximately ₹45,000 from the shop's cash box.
Despite informing the police, no action was taken, so the victim sought help from the court.
