सत्र न्यायालय वाराणसी ने एक गंभीर आपराधिक मामले में अभियुक्त राय साहब पुत्र नंदू उर्फ नंदलाल, निवासी ग्राम बरही कला, थाना फूलपुर द्वारा दायर जमानत प्रार्थना-पत्र को खारिज कर दिया है। यह आदेश न्यायाधीश जयप्रकाश तिवारी की अदालत ने दिया।
👉 मामला थाना फूलपुर में दर्ज बीएनएस की धारा 105, 190, 191(2) से संबंधित है। अभियोजन के अनुसार, वादी संदीप सोनकर का भाई मंदीप सोनकर दिनांक 1 फरवरी 2025 को जौनपुर स्थित नेवड़िया जा रहा था। रास्ते में ग्राम सभा नेनूहापुर के पास नहर किनारे गिरने के बाद, अभियुक्त राय साहब समेत चार लोगों ने उसे बेरहमी से पीटा।
👉 इलाज के दौरान घायल मंदीप कोमा में चला गया और बाद में उसकी मौत हो गई। पोस्टमार्टम रिपोर्ट में शरीर पर कुल 22 गंभीर चोटें और मौत का कारण “सप्टीसीमिया, कोएगुलोपैथी तथा पेट में बाहरी आघात” बताया गया है।
👉 प्रार्थी अभियुक्त की ओर से कहा गया कि उसका घटना से कोई संबंध नहीं है, वह निर्दोष है और उसका घर मृतक से 10 किमी दूर है। लेकिन वादी के वरिष्ठ फौजदारी अधिवक्ता संतोष मिश्रा ने जमानत का पुरजोर विरोध किया।
👉 कोर्ट ने यह मानते हुए कि अभियुक्त नामजद है, अपराध गंभीर प्रकृति का है और उसके विरुद्ध जांच लंबित है — जमानत देने का कोई पर्याप्त आधार नहीं पाया। न्यायालय ने स्पष्ट किया कि इस स्तर पर अभियुक्त को जमानत नहीं दी जा सकती और उसका प्रार्थना-पत्र निरस्त किया जाता है।

Court Rejects Bail Plea of Accused Rai Sahab in Fatal Assault Case

The Sessions Court of Varanasi has rejected the bail application of an accused, Rai Sahab, son of Nandu alias Nandlal, a resident of Barahi Kala village, Phulpur police station. The order was issued by the court of Judge Jaiprakash Tiwari.
Case Details
* The case, registered at Phulpur police station, is related to Sections 105, 190, and 191(2) of the BNS (Bharatiya Nyaya Sanhita).
* According to the prosecution, the complainant's brother, Mandeep Sonkar, was on his way to Nevariya, Jaunpur, on February 1, 2025.
* After falling near a canal in the Nenuahapur village area, he was brutally beaten by the accused, Rai Sahab, and three other individuals.
* Mandeep sustained severe injuries, went into a coma during treatment, and later died.
* The post-mortem report revealed a total of 22 serious injuries on his body. The cause of death was stated as "septicemia, coagulopathy, and external trauma to the abdomen."
Court's Decision
* The defense argued that the accused had no connection to the incident, was innocent, and lived 10 km away from the deceased.
* However, the complainant's senior criminal advocate, Santosh Mishra, strongly opposed the bail.
* The court found no sufficient grounds to grant bail, noting that the accused was named in the FIR, the crime was of a serious nature, and the investigation was ongoing.
* The court made it clear that bail could not be granted to the accused at this stage and dismissed his application.
