धोखाधड़ी, कूटरचना के मामले में कोर्ट ने दिया अग्रिम विवेचना का आदेश
फर्जी मालिक बन ट्रस्ट डीड कराकर भवन कब्जा करने का है आरोप

पत्नी एवं बेटी के साथ मिलकर कूटरचना और धोखाधड़ी करके फर्जी मालिक बनकर मकान का ट्रस्ट डीड बनवाकर उसे कब्जा करने के मामले में पुलिस द्वारा दाखिल अंतिम रिपोर्ट कोर्ट ने खारिज कर दी। मुख्य न्यायिक मजिस्ट्रेट मनीष कुमार की अदालत ने यह आदेश गढ़वासी टोला, चौक निवासिनी वादिनी प्रभा चोपड़ा की ओर से दाखिल प्रोटेस्ट प्रार्थना पत्र पर सुनवाई के बाद दिया।

👉 प्रकरण के अनुसार वादिनी प्रभा चोपड़ा ने कोर्ट के आदेश पर केंट थाने में प्राथमिकी दर्ज कराई थी। आरोप था कि मकान नम्बर सीके 8/49 मोहल्ला गढ़वासी टोला, चौक की तनहा व एक मात्र स्वामी वादिनी के पिता स्व. देव कुमार चोपड़ा थे तथा नगर निगम के अभिलेखों में भी उसके पिता का नाम दर्ज है। उनके मृत्यु के बाद वादिनी व वादिनी के भाई का नाम बतौर स्वामी अंकित है। इस बीच प्रार्थिनी अपने पिता के ग्रेटर नोएडा में रहने के दौरान उनके आदेशानुसार कुछ महीनो में वाराणसी आकर अपने भवन उपरोक्त की देखरेख व साफ-सफाई के लिए आती जाती रहती है। प्रार्थिनी जब 5 अगस्त 2018 को अपने पिता के उपरोक्त भवन की देखरेख व साफ-सफाई व कुछ जरूरी सामान लेने वाराणसी आयी तभी अभियुक्तगण प्रार्थिनी को घर में घुसने से बलपूर्वक रोक दिये तथा प्रार्थिनी को अमर्यादित व अश्लील शब्दों से अपमानित कर कहने लगे कि उक्त भवन उसके पिता का नहीं, बल्कि ट्रस्ट का मकान है तथा प्रार्थिनी को अश्लील गालियां देकर तथा आइन्दा आने पर जान से मार देने की धमकी देकर भगा दिये। इस पर जब प्रार्थिनी ने 06 अगस्त 2018 को विपक्षियों द्वारा कूटरचना व जालसाजी कर छल की नियत से बनवाये गये ट्रस्ट डीड की प्रति निकलवाई, तब विपक्षियों के फर्जीवाडा की सच्चाई सामने आ पायी। उसे पता चला कि विपक्षियों ने 14 दिसंबर 2017 को छल, जालसाजी व कूटरचना के आधार पर बनाये गये ट्रस्ट को न्यास विलेख के रूप में उप निबन्धक द्वितीय वाराणसी के कार्यालय में पंजीकृत करा लिये। जबकि वे लोग उक्त भवन के स्वामी नहीं है।
👉 प्रार्थिनी के पिता जो भवन के वैध स्वामी है के द्वारा कोई न्यास विलेख न तो निष्पादित किया गया है और ना उसे पंजीकृत कराया गया है, बल्कि सम्पूर्ण फर्जीवाड़ा विपक्षी रमेश चोपड़ा व उनकी पत्नी मीरा चोपडा व उनकी पुत्री रिचा चोपड़ा द्वारा साजिशन किया व कराया गया है। इस मामले में पुलिस ने विवेचना के बाद फाइनल रिपोर्ट कोर्ट में दाखिल कर दी। जिसके बाद प्रार्थनी ने कोर्ट में अपने अधिवक्ताओं के माध्यम से प्रोटेस्ट प्रार्थना पत्र दाखिल कर पुलिस की अंतिम रिपोर्ट निरस्त कर अग्रिम विवेचना की अपील की थी। प्रोटेस्ट प्रार्थना पत्र में वादिनी ने कहा था कि मामले के विवेचक रहे एसआई मनोज कुमार पाण्डेय द्वारा वादिनी व उसके भाई का बयान लिया गया है। जिसमें वादिनी व भाई द्वारा स्पष्ट रूप से विपक्षीगणो द्वारा विना किसी अधिकार के छल व कपट पूर्वक, कूटरचना व जालसाजी कर न्यास विलेख तैयार करके व उसको पंजीकृत कराया जाना बताया गया है इस प्रकार विपक्षीगणों द्वारा गंभीर व संज्ञेय अपराध किया गया है। जबकि विवेचक द्वारा प्रार्थिनी/वादिनी व उसके भाई के कथनों को पश्चातवर्ती विवेचको द्वारा पुष्ट व तस्दीक करने का न तो कोई प्रयास किया गया और ना वादिनी व उसके भाई का कोई पुष्टि कारक बयान लिया गया इससे स्पष्ट है कि विवेचक ने लापरवाही बरते हुए विपक्षियों से मिलीभगत करते हुए मामले में अंतिम रिपोर्ट लगाकर कोर्ट में दाखिल कर दिया है। अदालत ने पत्रावली के अवलोकन के बाद पुलिस की अंतिम रिपोर्ट निरस्त कर अग्रिम विवेचना का आदेश दिया।

Court Rejects Police Final Report, Orders Further Investigation in Fraud and Forgery Case
Varanasi:
The court has rejected the final report filed by the police in a case of forgery and fraud where a house was allegedly seized by creating a fake trust deed. The Chief Judicial Magistrate Manish Kumar's court issued the order after hearing a protest petition filed by the plaintiff, Prabha Chopra, a resident of Garhwasi Tola, Chowk. The plaintiff was represented in court by senior advocates Anuj Yadav, D.N. Yadav, Naresh Yadav, and Sandeep Yadav.
Case Background:
Plaintiff Prabha Chopra had filed an FIR at the Cantt police station based on a court order. She alleged that her father, the late Dev Kumar Chopra, was the sole owner of the house located at CK 8/49, Garhwasi Tola, Chowk, and his name was also registered in the municipal records. After his death, the names of the plaintiff and her brother were listed as owners.
The plaintiff stated that she would periodically visit Varanasi from Greater Noida to look after and clean her father's house. On August 5, 2018, when she came to the house, the accused forcibly stopped her from entering. They allegedly told her that the house belonged to a trust, not her father, and threatened to kill her if she ever returned.
Discovery of the Fraud:
On August 6, 2018, the plaintiff obtained a copy of the trust deed, which revealed the fraud. She discovered that on December 14, 2017, the accused had fraudulently and deceitfully registered a trust deed at the office of the Sub-Registrar II, Varanasi. The plaintiff's father, the legitimate owner of the property, had never executed or registered any such deed. The plaintiff alleged that the entire forgery was a conspiracy orchestrated by Ramesh Chopra, his wife Meera Chopra, and their daughter Richa Chopra.
Police Negligence and Court's Decision:
After a police investigation, a final report was filed in the court, which the plaintiff contested by filing a protest petition. In her petition, the plaintiff argued that the investigating officer, SI Manoj Kumar Pandey, had been negligent and colluded with the accused. She pointed out that while she and her brother had clearly stated in their testimonies that the accused had fraudulently created and registered the trust deed, the investigator had made no effort to corroborate their statements or gather supporting evidence.
After reviewing the case file, the court rejected the police's final report and ordered a further investigation into the matter.
