न्यायालय कार्यपालक मजिस्ट्रेट/पुलिस उपायुक्त कमिश्नरेट ने थाना लक्सा क्षेत्र के विवादित मकान डी-52/73 मोहल्ला लक्ष्मीकुण्ड को लेकर चल रहे कब्जेदारी विवाद में अहम आदेश पारित किया है।

👉 मामला गणेश जी कपूर बनाम बिहारी लाल के बीच स्वामित्व व कब्जेदारी को लेकर चल रहा था। पुलिस की चालानी रिपोर्ट के आधार पर पहले धारा 145 दंड प्रक्रिया संहिता के अंतर्गत कार्यवाही प्रारंभ की गई थी, लेकिन दोनों पक्षों द्वारा प्रस्तुत आपत्तियों, बहस और उपलब्ध साक्ष्यों के परीक्षण के बाद न्यायालय ने पाया कि विवाद का सीधा संबंध स्वामित्व से है, जिसका निर्धारण केवल दीवानी न्यायालय ही कर सकता है।
👉 गौरतलब है कि विवादित संपत्ति को लेकर पहले से ही वाद संख्या 641/2016 राजेंद्र कुमार व अन्य बनाम दीपक कुमार सेठ व अन्य के नाम से सिविल जज (जू0 डि0) वाराणसी की अदालत में विचाराधीन है, जिसकी अगली तारीख 13 अगस्त 2025 नियत है।
👉 न्यायालय ने स्पष्ट किया कि स्वामित्व संबंधी मामले में धारा 145 सीआरपीसी की कार्यवाही विधि सम्मत नहीं है। इसलिए 24 जुलाई 2024 को जारी प्रारंभिक आदेश को निरस्त कर दिया गया। साथ ही थाना प्रभारी लक्सा को निर्देशित किया गया है कि मौके पर शांति व्यवस्था बनाए रखने के लिए सतर्क दृष्टि रखें और आवश्यकता पड़ने पर नियमानुसार कार्यवाही करें।

Executive Magistrate's Major Order: Section 145 Cr.P.C. Proceedings Quashed
Varanasi.
In a significant ruling, the Court of the Executive Magistrate/Deputy Commissioner of Police, Commissionerate, has passed a key order regarding a possession dispute over the contentious house D-52/73 in the Luxa police station area of the Laxmi Kund neighborhood.

👉 The case was a dispute between Ganesh Ji Kapoor and Bihari Lal regarding ownership and possession. Based on a report from the police, proceedings were initially initiated under Section 145 of the Code of Criminal Procedure. However, after examining the objections, arguments, and evidence presented by both parties, the court found that the dispute was directly related to ownership, which can only be determined by a civil court.
👉 It is notable that a civil suit concerning the disputed property, with case number 641/2016 (Rajendra Kumar and others vs. Deepak Kumar Seth and others), is already pending in the court of the Civil Judge (Junior Division), Varanasi. The next hearing date is scheduled for August 13, 2025.
👉 The court made it clear that proceedings under Section 145 Cr.P.C. are not legally valid in a matter concerning ownership. Therefore, the initial order issued on July 24, 2024, was quashed. The Station House Officer (SHO) of Luxa police station was also directed to maintain a vigilant watch to ensure peace and order at the site and to take action as per the rules if necessary.
