अपर मुख्य न्यायिक मजिस्ट्रेट विवेक चौधरी की अदालत ने थाना मिर्जामुराद में दर्ज वर्ष 1995 के एक गंभीर ट्रक चोरी व टायर चोरी के मामले में चार आरोपियों को संदेह का लाभ देते हुए दोषमुक्त कर दिया है। अदालत ने कान्ता यादव, श्यामलाल, बंशी यादव और विजई धोबी के विरुद्ध भारतीय दंड संहिता की धारा 392 व 411 के तहत लगाए गए आरोपों को खारिज करते हुए उन्हें बरी कर दिया।
👉 मामले में अभियोजन पक्ष द्वारा यह आरोप लगाया गया था कि वादी की गाड़ी संख्या UP 65A 5817, जो बनारस से मॉल लोड कर कानपुर जा रही थी, 16 मई 1995 की रात मिर्जामुराद क्षेत्र में चोरी हो गई थी। बाद में ट्रक कपसेठी मार्ग पर कच्चे रास्ते पर खड़ा पाया गया था और उसके चार टायर गायब मिले थे।

👉 बचाव पक्ष की ओर से फौजदारी अधिवक्ता द्वारा तर्क दिया गया कि अभियुक्तों के खिलाफ कोई प्रत्यक्ष साक्ष्य नहीं है और न ही बरामद टायरों की कोई स्पष्ट पहचान या शिनाख्त करवाई गई थी। साथ ही, गवाहों के बयानों में विरोधाभास और अस्पष्टता भी सामने आई। पुलिस द्वारा की गई बरामदगी की प्रक्रिया में भी कई खामियां उजागर हुईं, जैसे कि कोई स्वतंत्र गवाह न होना, बरामद टायरों की शिनाख्त न कराना और कथित गवाहों की याददाश्त में भारी भ्रम।
👉 अदालत ने अपने आदेश में कहा कि अभियोजन पक्ष आरोप साबित करने में विफल रहा है और संदेह का लाभ अभियुक्तों को दिया जाना न्यायसंगत है।
👉 अदालत ने मुकदमा संख्या 1984/2012, मु.अ.सं. 67/1995 के तहत दर्ज इस मामले में सभी अभियुक्तों को आरोपों से दोषमुक्त कर दिया।
