विशेष न्यायालय (भ्रष्टाचार निवारण अधिनियम) की न्यायाधीश पूनम पाठक की अदालत ने परिवाद संख्या-728/2019, थाना सिगरा से जुड़े एक मामले में अभियुक्त विजय कुमार मिश्रा की अग्रिम जमानत प्रार्थना पत्र को खारिज कर दिया। अभियुक्त विजय कुमार मिश्रा पुत्र स्व. रामनगीना मिश्रा, निवासी मोहल्ला चंदुआ छित्तूपुर पर फर्जी दस्तावेज बनाकर संपत्ति कब्जाने का आरोप है।

👉 अभियोजन के अनुसार, परिवादी अजय कुमार रावत ने आरोप लगाया कि उनकी मां स्व. पत्ती देवी के नाम दर्ज मकान को अभियुक्तों ने अपनी मां माया देवी के नाम फर्जी बैनामा करवा कर कब्जाने की कोशिश की। आरोप है कि अभियुक्तों ने प्रार्थी के मकान का हिस्सा तोड़कर जबरन निर्माण कार्य शुरू किया और जान से मारने की धमकी भी दी। मामले में थाना सिगरा में एफआईआर दर्ज होने के बाद अंतिम रिपोर्ट भेजी गई, जिसके विरुद्ध प्रोटेस्ट याचिका दाखिल हुआ, उसके बाद न्यायालय ने उस प्रार्थना पत्र पर परिवाद दर्ज करते हुए साक्ष्य संकलित कर अभियुक्तगण को धारा 419,420 भारतीय दण्ड संहिता में तलब किया, अभियुक्तगण द्वारा न्यायालय में उपस्थित होने के उपरान्त काफी समय से फरार चल रहे थे, जिसके कारण न्यायालय द्वारा गैर जमानती वारंट जारी किए जाने के बाद, अभियुक्तगण द्वारा अग्रिम जमानत प्रार्थना पत्र माननीय न्यायालय के समक्ष प्रस्तुत किया गया जिसे न्यायालय ने आज निरस्त कर दिया।

In a case of grabbing property through a fraudulent sale deed, the anticipatory bail application of one person has been rejected.
Varanasi:
The court of special judge (Prevention of Corruption Act), Poonam Pathak, has rejected the anticipatory bail application of the accused, Vijay Kumar Mishra, in a case related to complaint number 728/2019, Sigra police station. The accused, Vijay Kumar Mishra, son of late Ramnagina Mishra, a resident of Chandua Chhittupur, is accused of grabbing property by creating fraudulent documents.
"In the court, advocates Ashok Kumar Yadav and Vijay Srivastava opposed the bail application on behalf of the complainant."
According to the prosecution, the complainant, Ajay Kumar Rawat, alleged that the accused tried to seize a house registered in the name of his late mother, Patti Devi, by getting a fraudulent sale deed registered in the name of their mother, Maya Devi. It is alleged that the accused broke a part of the complainant's house, started forced construction work, and also gave death threats. After the FIR was registered in this case at Sigra police station, a final report was sent, against which a protest petition was filed. Subsequently, the court registered a complaint on that application, collected evidence, and summoned the accused under sections 419 and 420 of the Indian Penal Code. The accused had been absconding for a long time after appearing in court, due to which a non-bailable warrant was issued by the court. After that, the accused filed an anticipatory bail application before the court, which the court has rejected today.
