मुख्य न्यायिक मजिस्ट्रेट मनीष कुमार द्वितीय की अदालत ने थाना कैंट में दर्ज एक गंभीर आपराधिक मामले में आरोपी इंद्रदेव यादव पुत्र सरबजीत यादव को साक्ष्य के अभाव में संदेह का लाभ देते हुए दोषमुक्त कर दिया।

मामले का संक्षेप
👉अभियोजन के अनुसार, रामकरन उर्फ पताली का पुत्र संदीप अपने दुकान पर जीविकोपार्जन के लिए चूल्हे पर आलू उबाल रहा था। तभी चौकाघाट से पाण्डेयपुर की ओर आ रही अभिषेक बस सर्विस की बस (संख्या UP65G0399) तेज रफ्तार से दुकान में घुस गई। टक्कर से दुकान टूट गई और बस ने संदीप को बुरी तरह कुचल दिया, जिससे उसकी मौके पर ही मौत हो गई।
👉 लोगों ने पीछा कर बस को पाण्डेयपुर चौराहे पर पकड़ लिया। सूचना पर पुलिस व वरिष्ठ अधिकारी मौके पर पहुंचे। घटना के प्रत्यक्षदर्शी रमेश कुमार पटेल पुत्र रामलखन और रामचंद्र पुत्र रामदेव बताए गए।
👉 बता दें कि वादी की तहरीर पर थाना कैंट पुलिस ने भारतीय दंड संहिता की धारा 279, 304A व 427 में मुकदमा दर्ज किया था।
👉 अदालत ने सबूतों के अभाव में आरोपी को बरी कर दिया।

Man Dies in Bus Accident, Court Acquits Accused Due to Lack of Evidence

The court of Chief Judicial Magistrate Manish Kumar II acquitted the accused, Indradev Yadav, son of Sarabjit Yadav, in a serious criminal case registered at Cantt Police Station. The court gave the accused the benefit of the doubt due to insufficient evidence.
The defense was represented in court by criminal advocates Siddharth Srivastava, Devvardhan Yadav, and Piyush Yadav.
Case Summary
* According to the prosecution, Sandeep, son of Ramkaran alias Patali, was boiling potatoes on a stove for his livelihood at his shop. At that time, a bus (number UP65G0399) belonging to Abhishek Bus Service, traveling at high speed from Chaukaghat towards Pandeypur, crashed into his shop. The impact destroyed the shop and severely crushed Sandeep, who died on the spot.
* People chased the bus and caught it at Pandeypur crossing. Police and senior officials were informed and reached the scene. The eyewitnesses to the incident were identified as Ramesh Kumar Patel, son of Ramlakhan, and Ramchandra, son of Ramdev.
* Based on the complaint filed by the plaintiff, Cantt Police registered a case under sections 279, 304A, and 427 of the Indian Penal Code.
* The court acquitted the accused due to a lack of evidence.
