कांग्रेस सांसद राहुल गांधी द्वारा पिछले वर्ष अमेरिका यात्रा के दौरान भारत में सिक्खों को लेकर दिए गए बयान को लेकर वाराणसी की अदालत में गुरुवार को सुनवाई हुई। यह सुनवाई एसीजेएम चतुर्थ/एमपी-एमएलए कोर्ट नीरज कुमार त्रिपाठी की अदालत में संपन्न हुई।
👉 सुनवाई के दौरान राहुल गांधी की ओर से अधिवक्ता अनुज यादव ने प्रार्थना पत्र दाखिल करते हुए विभिन्न विधिक प्रावधानों का हवाला दिया और वादी पक्ष को उसकी प्रतिलिपि उपलब्ध कराई। उन्होंने सुप्रीम कोर्ट की नजीरों को भी प्रस्तुत करते हुए कहा कि इस स्तर पर राहुल गांधी को सुना जा सकता है।
👉 अदालत ने दलीलें सुनने के बाद मामले की अगली तिथि 4 सितंबर नियत कर दी। इस दौरान वादी की ओर से अधिवक्ता अलख नारायण सिंह और विवेक शंकर तिवारी अदालत में मौजूद रहे।
सत्र न्यायालय के आदेश पर अवर न्यायालय कर रहा सुनवाई
👉 गौरतलब है कि कुछ दिन पहले विशेष न्यायाधीश (एमपी/एमएलए कोर्ट) की अदालत ने अवर न्यायालय को निर्देश दिया था कि इस मामले की सुनवाई विधि के सिद्धांतों के अनुसार दोबारा की जाए। इसी आदेश के अनुपालन में यह मामला वर्तमान में अवर न्यायालय में लंबित है।
नागेश्वर मिश्र ने लगाया था गृहयुद्ध भड़काने का आरोप
👉 ज्ञात हो कि बीते वर्ष सितंबर माह में अमेरिका प्रवास के दौरान राहुल गांधी ने अपने भाषण में कहा था कि भारत में सिक्खों के लिए माहौल अच्छा नहीं है, क्या एक सिक्ख के रूप में पगड़ी बांधने, कड़ा पहनने और गुरुद्वारा जाने की अनुमति मिलेगी?
👉 इस बयान को तिलमापुर, सारनाथ निवासी नागेश्वर मिश्र ने देश में गृह युद्ध भड़काने की साज़िश करार देते हुए न्यायिक मजिस्ट्रेट (द्वितीय) की अदालत में वाद दाखिल किया था।
👉 हालांकि, सुनवाई के बाद अपर मुख्य न्यायिक मजिस्ट्रेट (एमपी-एमएलए) की अदालत ने इस वाद को खारिज कर दिया था। इसके खिलाफ नागेश्वर मिश्र ने सत्र न्यायालय में निगरानी अर्जी दाखिल की थी। सत्र न्यायालय ने उनकी अर्जी स्वीकार करते हुए अवर न्यायालय को पुनः सुनवाई का आदेश दिया था।

Rahul Gandhi's Statement in America Leads to Hearing in Varanasi Court, Next Date Set for September 4
Varanasi:
A Varanasi court on Thursday heard a case related to a statement made by Congress MP Rahul Gandhi about Sikhs in India during his trip to America last year. The hearing took place in the court of ACJM IV/MP-MLA Court Neeraj Kumar Tripathi.
* During the hearing, Rahul Gandhi's lawyer Anuj Yadav filed an application, citing various legal provisions and providing a copy to the plaintiff. He also presented precedents from the Supreme Court, stating that Rahul Gandhi could be heard at this stage.
* After hearing the arguments, the court scheduled the next hearing for September 4. The plaintiff's lawyers, Alakh Narayan Singh and Vivek Shankar Tiwari, were present in the court.
Lower Court Hearing on Session Court's Order
* It is worth noting that a few days ago, the special judge (MP/MLA Court) instructed the lower court to reconsider the case according to the principles of law. The case is currently pending in the lower court in compliance with this order.
Nageshwar Mishra Accused of Inciting Civil War
* It is known that during his visit to America in September of last year, Rahul Gandhi said in his speech that the environment for Sikhs in India was not good. He questioned whether a Sikh would be allowed to wear a turban, a kara, and go to a gurdwara.
* Nageshwar Mishra, a resident of Tilmapur, Sarnath, filed a lawsuit in the court of the Judicial Magistrate (II), calling the statement a conspiracy to incite a civil war in the country.
* The court of the Additional Chief Judicial Magistrate (MP-MLA) had previously dismissed the suit. Nageshwar Mishra then filed a revision application in the session court against this dismissal. The session court accepted his application and ordered the lower court to conduct a rehearing.
