एफटीसी प्रथम के न्यायाधीश कुलदीप सिंह द्वितीय की अदालत ने थाना बड़ागांव के एक गंभीर मामले में आरोपी दीपक कुमार पटेल उर्फ राहुल को संदेह का लाभ देते हुए दोषमुक्त कर दिया। अदालत ने कहा कि अभियोजन पक्ष द्वारा प्रस्तुत साक्ष्य परस्पर विरोधाभासी और अविश्वसनीय हैं।

आरोप
👉 मामला वर्ष 2019 का है, जब पीड़िता चंदा देवी निवासी लखापुर ने थाने में तहरीर देकर आरोप लगाया था कि आरोपी ने शादी का झांसा देकर तीन साल तक उसका यौन शोषण किया और बाद में शादी से इनकार कर जान से मारने की धमकी दी। इसी आधार पर थाना बड़ागांव में मुकदमा अपराध संख्या 602/2019, धारा 376 व 506 भा.दं.सं. के तहत दर्ज हुआ था।
अदालत का निर्णय
👉 माननीय न्यायाधीश ने आदेश में कहा कि प्रस्तुत सत्र परीक्षण संख्या-17/2020 में आरोप सिद्ध करने योग्य पर्याप्त साक्ष्य नहीं मिले, इसलिए आरोपी को सभी आरोपों से दोषमुक्त किया जाता है। अभियुक्त जमानत पर था, जिसे अब निरस्त कर दिया गया। साथ ही, धारा 437(ए) दं.प्र.सं. के तहत दाखिल बन्धपत्र छह माह तक प्रभावी रहेगा।
झूठी गवाही पर नोटिस
👉 अदालत ने यह भी माना कि पीड़िता (पी.डब्ल्यू.-1) द्वारा दिये गये बयान तहरीर से भिन्न, विरोधाभासी और मिथ्या हैं। इस पर न्यायालय ने उसके विरुद्ध धारा 383 बीएनएसएस (पूर्व धारा 344 दं.प्र.सं.) में आपराधिक मामला दर्ज करने का निर्देश दिया है और कारण बताओ नोटिस जारी किया है कि क्यों न उसे झूठी गवाही देने के लिए दण्डित किया जाए।

"Sexual Exploitation Under Pretext of Marriage: Accused Acquitted Due to Lack of Evidence, Victim Issued Notice for Perjury"

The court of FTC-I Judge Kuldeep Singh II acquitted the accused, Deepak Kumar Patel alias Rahul, in a serious case from the Baragaon police station, giving him the benefit of the doubt. The court stated that the evidence presented by the prosecution was contradictory and unreliable.
"The defense was represented by senior criminal advocates Haushila Prasad Patel, Ravindra Kumar Singh, and Vinod Verma."
Allegations
The case dates back to 2019 when the victim, Chanda Devi, a resident of Lakhapur, filed a complaint at the police station. She alleged that the accused sexually exploited her for three years under the pretext of marriage and later refused to marry her and threatened to kill her. Based on this, FIR No. 602/2019 was registered at Baragaon police station under Sections 376 and 506 of the Indian Penal Code.
Court's Decision
The honorable judge, in the order, stated that in the presented session trial number 17/2020, there was insufficient evidence to prove the charges, and therefore, the accused is acquitted of all charges. The accused was on bail, which has now been canceled. Additionally, the bond filed under Section 437(A) of the Code of Criminal Procedure will remain in effect for six months.
Notice for Perjury
The court also found that the victim's (P.W.-1) statement was different from, contradictory to, and false compared to her initial complaint. The court has directed that a criminal case be filed against her under Section 383 of the Bharatiya Nyaya Sanhita (formerly Section 344 of the Code of Criminal Procedure) and has issued a show-cause notice as to why she should not be punished for giving false testimony.
