विशेष न्यायालय (पॉक्सो एक्ट) के न्यायाधीश अजय कुमार तृतीय की अदालत ने थाना कैंट क्षेत्र के चर्चित पॉक्सो केस में आरोपी जमशेद शाह पुत्र सलीम शाह निवासी बरही नेवादा, थाना फूलपुर, वाराणसी की ओर से प्रस्तुत द्वितीय जमानत प्रार्थना पत्र को खारिज कर दिया।
अभियुक्त की ओर से दायर जमानत अर्जी में कहा गया था कि वह निर्दोष और गरीब व्यक्ति है तथा 25 जुलाई 2025 से जिला कारागार वाराणसी में निरुद्ध है। बचाव पक्ष का तर्क था कि पीड़िता की सही जन्मतिथि को लेकर विरोधाभास है और अभियोजन पक्ष ने किसी स्वतंत्र गवाह को प्रस्तुत नहीं किया।
वहीं, वादी मुकदमा की ओर से फौजदारी अधिवक्ता श्याम सुंदर चौरसिया व विनोद कुमार ने जमानत का घोर विरोध करते हुए अदालत में कहा कि आरोपी ने अवयस्क पीड़िता को बहला-फुसलाकर भगा ले जाकर उसके साथ शारीरिक संबंध बनाए।
अदालत ने केस डायरी व साक्ष्यों का अवलोकन करते हुए पाया कि घटना के समय पीड़िता अवयस्क थी। पीड़िता के बयान में विरोधाभास मौजूद होने के बावजूद प्रथम दृष्टया अभियुक्त के खिलाफ गंभीर आरोप सिद्ध होते हैं। न्यायाधीश ने कहा कि अपराध की प्रकृति गंभीर है और ऐसे में आरोपी को जमानत देना न्यायोचित नहीं होगा। अंततः अदालत ने जमशेद शाह की द्वितीय जमानत प्रार्थना पत्र निरस्त कर दिया।

Court Rejects Bail Application of POCSO Accused
Varanasi.
The court of Special Judge (POCSO Act) Ajay Kumar III has rejected the second bail application filed by the accused Jamshed Shah, son of Salim Shah, a resident of Barhi Newada, Phulpur police station, Varanasi, in the high-profile POCSO case of the Cantt police station area.
The bail application filed by the accused stated that he is an innocent and poor person who has been in the Varanasi District Jail since July 25, 2025. The defense argued that there was a contradiction regarding the victim's correct date of birth and that the prosecution had not presented any independent witnesses.
On the other hand, criminal advocates Shyam Sundar Chaurasia and Vinod Kumar, on behalf of the plaintiff, strongly opposed the bail, telling the court that the accused had enticed and abducted the minor victim and had a physical relationship with her.
After reviewing the case diary and evidence, the court found that the victim was a minor at the time of the incident. Despite the contradictions in the victim's statement, serious charges are prima facie proven against the accused. The judge stated that the nature of the crime is serious and it would not be just to grant bail to the accused in such a situation. Ultimately, the court dismissed Jamshed Shah's second bail application.
