आर्म्स एक्ट के मामले में पुलिस ने किया था गिरफ्तार

सिगरा पुलिस को सोमवार को कोर्ट से तगड़ा झटका लगा। मुख्य न्यायिक मजिस्ट्रेट मनीष कुमार की अदालत ने आर्म्स एक्ट के मामले में लालपुर पाण्डेयपुर निवासी आरोपित इकबाल खान उर्फ चंडल की न्यायिक रिमांड की अर्जी निरस्त कर दी।
अदालत में बचाव पक्ष की ओर से वरिष्ठ अधिवक्ता अनुज यादव, अभिषेक श्रीवास्तव पंकज, नरेश यादव व संदीप यादव ने पक्ष रखा।
👉 प्रकरण के अनुसार आर्म्स एक्ट के मामले में सिगरा पुलिस द्वारा लालपुर पाण्डेयपुर निवासी आरोपित इकबाल खान उर्फ चंडूल को गिरफ्तार कर सोमवार को कोर्ट में पेश किया गया था। अदालत में आरोपित को पेश करने के बाद सिगरा पुलिस ने आरोपित का न्यायिक रिमांड बनाने की अपील की गयी। इस पर अदालत में बचाव पक्ष के अधिवक्ताओं ने न्यायिक रिमांड का विरोध किया। बचाव पक्ष के अधिवक्ताओं ने दलील दी कि सिगरा पुलिस ने आरोपित को फर्जी ढंग से गिरफ्तार कर उसे आरोपित बना दिया है। उसके पास से न ही कोई असलहा और न ही कोई कारतूस बरामद हुआ है। साथ ही पुलिस ने अपने कथानक में यह कहा है कि आरोपित का नाम सह अभियुक्त के वयान के आधार पर प्रकाश में आया है। ऐसे में मात्र उसके पूर्व के आपराधिक घटनाओं को देखते हुए उसे फर्जी ढंग से गिरफ्तार कर कोर्ट में पेश कर न्यायिक रिमांड बनाने की अपील की जा रही है। अदालत ने पत्रावली के अवलोकन के बाद पुलिस की ओर से दिये गये आरोपित की न्यायिक रिमांड वनाने की अर्जी को रिफ्यूज कर दिया। अदालत ने अपने आदेश में कहा कि आरोपित के पास से कोई बरामदगी नहीं हुई हैं। मात्र इस आशय से कि उसका पुराना आपराधिक इतिहास रहा है, उसे आरोपित नहीं बनाया जा सकता है। ऐसे में पुलिस की न्यायिक रिमांड की अर्जी रिफ्यूज की जाती है।

The Sigra police faced a major setback from the court on Monday. The court of Chief Judicial Magistrate Manish Kumar dismissed the police's application for judicial remand of the accused, Iqbal Khan alias Chandul, a resident of Lalpur Pandepur, in an Arms Act case.
Senior advocates Anuj Yadav, Abhishek Srivastava Pankaj, Naresh Yadav, and Sandeep Yadav represented the defense in the court.
👉 According to the case, the Sigra police had arrested the accused, Iqbal Khan alias Chandul, a resident of Lalpur Pandepur, in an Arms Act case and presented him in court on Monday. After presenting the accused in court, the Sigra police appealed for his judicial remand. Defense lawyers opposed the judicial remand in court. The defense lawyers argued that the Sigra police had falsely arrested the accused and framed him. Neither a weapon nor any cartridges were recovered from him. The police's statement also mentioned that the accused's name came to light based on the statement of a co-accused. Thus, merely based on his past criminal history, he was being falsely arrested and presented in court with an appeal for judicial remand. After reviewing the case file, the court refused the police's application for the accused's judicial remand. In its order, the court stated that no recovery was made from the accused. He cannot be made an accused merely because he has a past criminal history. Thus, the police's application for judicial remand is refused.
